These Terms of Service ("Terms") govern your use of the GrowKeep mobile application ("App") developed and operated by Figrski Technology LLC ("we", "us", or "our"). By downloading or using the App, you agree to these Terms.
1. Use of the App
GrowKeep is a plant care journal and garden tracker application. You may use the App for personal, non-commercial purposes in accordance with these Terms. You agree not to:
- Use the App for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or modify the App.
- Use the App in any way that could damage or impair its operation or availability.
- Upload content that is illegal, harmful, or infringes the rights of others.
2. Accounts
You must create an account to use GrowKeep. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@figrski.com.
3. Subscriptions and Payments
GrowKeep offers a free tier and a premium subscription ("GrowKeep Premium"). Premium subscriptions are offered at the following rates:
- Monthly: $4.99 per month
- Annual: $39.99 per year
All subscriptions are processed through the Apple App Store. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time in your Apple ID account settings.
Prices are in USD and may vary by region. We reserve the right to change subscription pricing with reasonable notice.
Refund requests are handled in accordance with Apple's App Store refund policies.
4. Free Tier Limitations
The free tier of GrowKeep includes:
- Up to 5 plants
- 1 garden
- 5 AI queries per month
- 5 active reminders
We reserve the right to modify free tier limits at any time with reasonable notice.
5. AI Plant Advisor
GrowKeep includes an AI-powered plant advisor feature ("AI Advisor") that provides general plant care guidance based on your plant and garden profiles.
The AI Advisor is for informational purposes only. Responses are generated by an AI language model and may not always be accurate, complete, or appropriate for your specific situation. The AI Advisor is not a substitute for professional horticultural, agricultural, or botanical advice. Always use your own judgement when following AI-generated recommendations, particularly for valuable, sensitive, or rare plants.
We are not liable for any loss, damage, or harm to plants, property, or persons arising from reliance on AI Advisor responses.
6. Your Content
You retain ownership of all content you create within the App, including photos, plant notes, and care logs ("Your Content"). By uploading content to GrowKeep, you grant us a limited, non-exclusive licence to store and display Your Content solely for the purpose of providing the App's services to you.
You are responsible for ensuring Your Content does not violate any applicable laws or third-party rights.
7. Availability and Changes
We strive to keep GrowKeep available at all times but do not guarantee uninterrupted service. We may update, modify, or discontinue features of the App at any time. We will endeavour to provide reasonable notice of significant changes.
8. Termination
You may stop using the App at any time and delete your account via Settings → Account → Delete account. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the App ceases and your data will be deleted in accordance with our Privacy Policy.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free or that any defects will be corrected.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Figrski Technology LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damage to property, arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in the State of Georgia, and you consent to the jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above or by in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms.
